Terms of Service

1. Description of Service

Culprit is a Shopify application that monitors your online storefront for silent failures — errors that affect customer experience but generate no visible alerts. The Service injects a lightweight JavaScript pixel into your storefront, collects anonymous technical error events, and surfaces them in a real-time dashboard with configurable alerting.

2. Eligibility

You must have an active Shopify store and be authorized to install apps on that store to use Culprit. By installing the app you represent that you meet these requirements.

3. Subscription and Billing

Culprit is offered on a paid subscription basis, billed through Shopify's Billing API. Current pricing is listed in the Shopify App Store. All subscriptions include a 7-day free trial. Billing begins automatically at the end of the trial period unless you cancel.

Subscriptions are billed on a 30-day recurring cycle. You may cancel at any time through your Shopify admin. Cancellation takes effect at the end of the current billing period. We do not offer partial refunds for unused subscription time except where required by law.

If your Shopify subscription lapses or you uninstall the app, your access to the Service will be suspended and your stored data will be deleted in accordance with our Privacy Policy.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of Shopify's Partner Program policies
• Attempt to reverse engineer, decompile, or extract the source code of the Service
• Use the Service to monitor storefronts you do not own or have explicit authorization to monitor
• Attempt to circumvent usage limits, billing, or security measures
• Transmit any data through the Service that contains personal customer information

5. Intellectual Property

The Service, including its code, design, and documentation, is the intellectual property of Culprit and is protected by applicable copyright and intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand assets.

6. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that all storefront failures will be detected. Storefront monitoring depends on the pixel being loaded by your visitors' browsers; failures that occur before the pixel loads may not be captured.

7. Limitation of Liability

To the fullest extent permitted by law, Culprit shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, including lost revenue or data, even if we have been advised of the possibility of such damages. Our total liability to you for any claim shall not exceed the amount you paid to us in the 30 days preceding the claim.

8. Indemnification

You agree to indemnify and hold Culprit harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

9. Termination

We reserve the right to suspend or terminate your access to the Service at any time for violation of these Terms, non-payment, or any other reason at our discretion, with or without notice. You may terminate your subscription at any time by uninstalling the app from your Shopify admin.

10. Changes to Terms

We may update these Terms at any time. We will notify you of material changes through the app or by email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the jurisdiction in which Culprit operates, without regard to conflict of law principles.
